TERMS & CONDITIONS

     
   

MAISONBULLE is a UK based company and as such, acts merely as a booking agent between the owners of the properties and their temporary renting guest or client.
When you book a property, you must complete, sign and return the booking form and pay the deposit as advised (or full amount if arrival is to take place within 30 days in low season, 60 days in high/peak season), as well as arrange for appropriate insurance.
The agent and/or property owner reserves the right to refuse to accept, or cancel bookings from clients who are not adequately insured against possible, travel, holiday and other risks that may come with residing in a place other than their regular home.
When you make a booking, you are confirming that you understand and have accepted our terms and conditions on behalf of yourself and all members of your party.
A confirmation invoice will be issued by Maisonbulle on behalf of the property’s owner, once payment is received to attest the rental contract between you, the guest, and the owner of the property rented.
The deposit shall only be refundable in accordance with booking condition outlined in part 4 & 5 of this document.

 

Rates

For your information, rates are to be understood per day and may have seasonal changes.
Unless otherwise specified, there are minimum stay of three (3) nights for Low Season, seven (7) nights for High Season and ten (10) nights for Peak Season for all the properties.
A list of what they include is provided for each property.
Please make sure to review them properly.
Airport transfers are included in the rental rate as follow:

1 x arrival Pick Up and 1 x departure Drop Off – Maximum 4 PAX plus luggage.

The requirement of further transportation needs to be mentioned at the time of booking, and will be subject to additional charges, to be settled with booking payments, prior to guests arrival.
All rates are inclusive of a commission covering the service offered by MAISONBULLE both to the property owner and/or any third party service company and the Client. It is the Client’s responsibility to appreciate and understand that the rates quoted and agreed upon prior to booking will not be subject to further discussion once confirmed.
All rates are quoted in Euros, inclusive of tax and subject to change without prior notice.
A deposit of 50% of the rental amount must be received within two (2) working days after initial confirmation of reservation by the client.
Confirmation of bookings and rates can only be guaranteed once the 50% required deposit has been received by MAISONBULLE.

Payments

Reservation is confirmed only upon reception of the required deposit by bank transfer in the same currency as quoted on the booking form, namely the Euro.
All charges attached to payment by bank transfer are under the responsibility and to be covered by the renting guest.
A scanned and email copy of the bank transfer is required.
In the case of bookings made less than 30 days prior to arrival, full payment is required within two (2) working days, or on arrival if it occurs less than two (2) working days after booking, whichever comes first.
Final payment is required at least 30 days prior to arrival for Low Season and 60 days for High/Peak Season bookings.
Full Balance of the booking price (including any changes made by any supplementary invoice) must be paid by the due date shown on the initial confirmation/invoice (either within 30 days in low season, 60 days in high/peak season prior to arrival date, or by return within these period).
In the case of disregard and non respect of the required delays provided for payment your reservations may be cancelled fully without notice.
Thus please ensure that payment are received promptly in order to guarantee your reservation.
Access to the property rented will not be possible unless full payment has been received.

Check In & Check Out time

Check in time is 4:00 pm.

Check out time is 11:00 am.

Early check in and late check out is subject to availability and at the discretion of the house owners.

Modifications and or cancellations by MAISONBULLE

Booking arrangements are often planned many months in advance and amendments do occasionally become inevitable. In the majority of cases, such changes would be considered to be minor, in which case the agent shall have absolute discretion as to wether the client is notified or not.
In the event that your booking should need modifications or cancellation for reasons previously unforeseen by MAISONBULLE, the client will be notified immediately and offered a varying option when possible. If the client prefers to cancel the booking altogether, a full refund of the total sums already perceived will be accorded.

Modifications and or cancellations by renting guest

Once your booking has been confirmed any changes to either accommodation, service, dates or names of the party requested by the client will incur a 50 euros amendment fee per person, in respect of each change, to cover costs incurred. Further supplement may apply with change of season. All amendments must be paid in full prior to entering the property.
Any requests for changes must be done in writing from the person who made the booking
Changes cannot necessarily be accommodated in all cases.
If a Client chooses to change their booking by transferring it to another person, the agent will arrange for such a transfer, provided that:

- The transferee meets all conditions of the holiday originally booked.

- The request for a transfer is sent to us in writing 30 days before departure together with full details of the transferee and payment of a fee of 50 euros per person to cover administrative costs.

- Transfer request and all supplemental cost and amendment fees are to be paid in full at the time of transfer by the original client, prior to guests arrival.

- Access to the property may not be granted unless all transfers and associate payments have been settled

If a client chooses to change their booking by modifying their dates, cancellation fee may apply above regular administrative costs. This charge is left to the property owner’s discretion and will be confirmed to the client within 2 working days.
If a client chooses to change their booking by moving their reservation to another property, cancellation fee will apply above regular administrative costs.
If a Client chooses to modify or abandon the arrangements made in regards to the property previously chosen for his stay, and or any other services, after arrival, he will be deemed to be breaking their contract with the owner of the property, or third party company, and neither the agent nor the property, or third party company owners may accept liability for any loss, damage or additional expenses resulting therefrom.
In such a case, no refunds for unused service or arrangements will be considered a possible option, unless the owner of the property, or of the third party company, is at fault and thus has been notified and given the opportunity to rectify the problem as per outlined it part 11 of this Terms and conditions.
All notice of cancellation must done in writing by the person who made the booking and be forwarded by email to be received by MAISONBULLE:

- 30 days prior to arrival for Low Season

- 45 days prior to arrival for High Season

- 60 days prior to arrival for Peak Season

Deposit will be refunded in full less 500 euros OR 20% of sums received (whichever is greater), if the booking is cancelled 61 days or more prior to arrival for low season’s booking ; 91 days or more for high and peak season’s booking.
In the event a reservation is cancelled less than 61 days in low season, 91 days in high/peak season, prior to arrival the deposit will be forfeited.
Reservations cancelled less than 61 days in low season, 91 days in high/peak season, prior to arrival are subject to a complete forfeiture of deposit to compensate the agency for the time and effort involved in making a booking and to compensate the owner for the loss of other potential bookings for the period concerned.
Final Payments are non-refundable.

House descriptions

MAISONBULLE makes every effort to ensure that the descriptions of the properties in its listing are accurate and that properties meet its required standards.
Each property is reviewed and selected carefully prior to its listing with the agency, and reassessment done periodically.
It is important to note that the properties must be fitted with furnishing and amenities in relation to the maximum of their guest capacities. Garden and pool furniture however may vary in quantities.
Colours and decorative accents vary in each locations.
However MAISONBULLE cannot accept responsibility for any alterations made to the property or its amenities, which are beyond its control. Nor can it accept responsibility for any injury, sickness, loss, damage, additional expense or inconvenience, directly or indirectly caused by or arising out of the use or condition of the property and its appliances, plumbing, gas, electrical or otherwise, exceptional weather conditions or owner's negligence.
Renting guests are requested not to interact personally with the pool systems and machineries.
Furthermore, MAISONBULLE and its representative, shall not, under any circumstances, hold any liability for insurance coverage, cancellation fee reimbursement under any claim, loss and damages from either party, their belongings and/or content, this applying as well to their guest,
employees and any other temporary occupant or visitor to the property and their belongings  and/or content.

Note:

Photographs are intended to give an overall impression rather than details of a specific property. The agent is not liable for any items of furniture
or chattels, which appear in the photographs, which may have been changed or remove from the property at the time of client’s arrival ; nor for
any aspects of the property environment which may have change since the photograph were taken.

To consider

In some instances a security deposit will be required upon arrival by the house owner or manager. The deposit is not to be cashed and will be refunded in full on day of departure, unless damages/repairs need to be performed, in which case refunds will be made by Cash or transfer, less cost of damages.
A security/telephone deposit of 300 euros is required for all villas if you require the use of the telephone for international calls. International calling rates are very high in Indonesia.
It is not always possible to receive a detailed statement from ‘Telkom’ the national telephone company prior to guest’s departure. Upon receipt of the telephone statement, a copy of the statement sign with the appropriate amount will be forwarded to you.
MAISONBULLE having no part in this transaction at any moment, will under no circumstances accept responsibilities in its regard.

Events and Parties

It must be respected that you cannot hold large parties in any of the private villas without prior arrangements. A licence must be obtained from the local authorities for such events and this will incur an extra fee. All properties differ with rules governing their usage for events and parties and at times a surcharge of up to the equivalent of a night’s rental, plus a local community or ‘Banjar Fee’ is applicable.
Normal bookings are for vacation purposes and special permission must be obtained for function where the number of people in attendance exceeds 150% of the capacity of the property.
The clients should be aware that these are private properties located in residential neighborhoods and, as such, not all functions or events can necessarily be accommodated. Much depends on the vagaries of the neighborhood’s residents.
Wedding and other events held at villas are becoming increasingly popular. Please be aware that the majority of properties owners will not accept a booking involving a function without prior confirmation that a function coordinator has been employed.
If you are planning to hold an event such as a wedding or any large party congregation of people at one of the properties, it would be best to bring it to the MAISONBULLE’s attention as soon as possible.
Remember when planning an event, that it is the responsability of the client to respect the laws and regulations of the country or area in which they choose to held their event. Neither Maisonbulle, nor the property owner may be held reliable for any limitations or disturbance caused by these said regulation.
Furthermore the agent and property owner reserve the right to terminate any event, should client’s behaviour, and or that of any member of their party, be likely, in our reasonable opinion or that of service and suppliers involved in the facilitation and organisation of the event, to cause distress, damage, annoyance and danger to the property, its employees or any third party, and or their property.

Insurance

Check your health insurance before coming to make sure you are covered. We strongly recommend that you take out a comprehensive insurance to protect you and all those that are accompanying you for the full time of your visit against illness, injury, death, loss of baggage and personal items, cancellations and other travel contingencies. We also strongly recommend a health insurance that covers medical evacuation for emergencies.
Maisonbulle and/or the property owner’s reserve the right to not accept booking should the client not have secured appropriate insurance prior to arrival.

Damage and Losses

Clients are responsible for leaving the property and its contents in good order and in a clean condition.
Clients are required to report any damage or loss of the property?s assets and fittings, that may arise during their occupation, to the property owner, guardian and/or to the agent and will be held responsible to reconcile payment of cost for repair or replacement prior to leaving the property?s premises.
The agent and or owner of the property reserves the right to repossess the property if clients or any member of the client?s party causes excessive damage or nuisance or engages in any unlawful activity, or is likely to cause distress, damage, annoyance and danger to their employees or any third party and or their property.
The number of people staying at the villa must not exceed the number of sleeping places indicated in the brochure except in the case of infants under two years. Some villas will limit the number of infants allowed under two years. Should you over-occupy the indicated sleeping places without previous agreement further charges may be levied or occupancy of the villa maybe refused.
Photography and/or film taken at within the property during your stay may not be used for commercial use or sold for profit without the authorisation of both Maisonbulle and the property owner.
Neither MAISONBULLE, nor the property owner shall be liable to the client, or to any other occupier or guest on the property, for any injury, sickness and additional expense or inconvenience related, though not exclusive, to loss or damage of their personal belongings, car and their contents.
Neither MAISONBULLE, nor the property owner, will accept responsibility for any delay, additional expense or inconvenience which may be cause directly or indirectly by events outside of their control such as late arrival of International flights, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government, or the failure of any machinery or equipment.

Complaints

Any dispute or complaint which Clients may have concerning their booking arrangements, must be reported immediately in person or by telephone, followed by writing to both the property owner and the villa manager present on site, as well as Maisonbulle.
All matter should first be taken up with the property owner with whom the client holds a contractual agreement, or its representative villa manager more often present on site.
If neither are available and or satisfaction cannot be obtained, the client may then contact, either immediately if urgent, or within 48 hours of the complaint or dissatisfaction arising a representative of Maisonbulle at the following address: info@mbulle.com so one of our representative may raise the complaint with the owner of the property.
If a Client fails to follow this procedure we will have been deprived of the opportunity to investigate and rectify any complaint whilst Clients were in the property and this will affect a Client’s rights under this contract.
Any complaint which cannot be satisfactorily resolved in the property must be reported in writing by post to the agents within 28 days of the Client’s return from holiday.
It is however understood that the booking contract entered is between the Client and the owner of the rental property booked. The agent, in any and all matter, simply holds the role of a facilitator and/or mediator and will under no circumstances accept responsibility or held liable for any issue that may arise past its role.
Accordingly, upon receipt of a Client’s letter, we will acknowledge it, investigate the points raised, and reply within 28 days.
If this is not possible, we will send an interim letter, advising of our progress.
All complaints have to be discussed and approved by the relevant villa owner and may take several weeks to come to final resolution.
No liability shall arise beyond the refund of the monies paid if any.
Neither MAISONBULLE, nor the property owner shall be held responsible for the irregularities that at times occur in the tropics in regards to water, electricity, telephone, etc…
Furthermore worksites, demonstrations of private or public origins do not enter the grounds for possible complaint to be considered. Accordingly, neither the agent, nor the property owner, may be held liable for any noise, nuisance or disturbance arising outside the property chosen,
and caused by third parties beyond their control. Both however shall make every effort to minimise such noise, nuisance or disturbance and forewarn the client, if they have knowledge of such possibility.

Limits on MAISONBULLE'S responsibility

MAISONBULLE, and its representatives, employees, shareholders, officers, directors, successors, agents and assigns, do not own or operate any entity which is to or does provide accommodation, goods, services related to your booking.
Maisonbulle Ltd provides access to rental properties, and from time to time restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result MAISONBULLE is not liable for any negligent or willful act of any such person or entity or of any third person. In addition and without limitation, MAISONBULLE is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of any means of transportation or for failure of any transportation mechanism to arrive or depart on time, as well as any inconvenience arising from the climate, environment and possible resulting pest of third world tropical living. There are certain inherent risks in travel, and clients assume all such risks with regard to these possibilities.

Last note on client's responsabilities

It is important that you check the details on your Confirmation Invoice when you receive it. In the event of any discrepancy, you should contact MAISONBULLE immediately for correction when applicable.
It is your responsibility to obtain all documents required for your holiday, including passports, visas, heath certificates and international driving licenses, to ensure that these are in valid status, and to take them with you.
Be aware most countries require, to be entered, a passport with a minimum validity of six months past the date of your return. Some destinations also require visas and you should contact the Embassy or Consulate of the country which you are planning to visit in good time before you travel.
You should also contact your medical advisor or a specialist vaccination centre for details on the measures you may need to take prior to departure. All children should travel on full passports.
No claim for refund or compensation will be at any time entertained should you, or any member of your party, be unable to proceed with your stay and use of related services, because of incorrect or missing personal documents.
Most people go on holiday for rest and relaxation, so if in our reasonable opinion or that of any person in authority, your behaviour is causing s, we reserve the right to terminate your holiday. Should this happen no refund or compensation would be paid.
If you lose any personal items whilst on holiday, please obtain a written report from the police, to help with any insurance claim upon your return.
